1. OWNERSHIP OF SITE; AGREEMENT TO TERMS OF USE

  1. These Terms and Conditions of Use (the “Terms of Use”) apply to this website. The Site is the property of Lir Business Services & Training Centre Ltd. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

  2. Lir Business Services & Training Centre Ltd reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Lir Business Services & Training Centre Ltd grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

  3. When you use the Site, you accept that your use of the Site will also be governed by the laws of Ireland and if any claim or dispute arises from your use of the Site or any of the information on it, you agree that the Irish courts will have exclusive jurisdiction over all such claims or disputes.

  4. Lir Business Services & Training Centre Ltd website is SSL Certificate compliant and trustworthy by having SSL web security to keep connections secure and private over an HTTPS connection. It is Level 1 PCI Compliant adheres to the highest level of payment industry standards, keeping your transactions private. TLS 1.2 to keep all transactions on our site private. Complete with DDoS Protection for reliable web hosting. Our servers have gone through extensive hacker testing to ensure our website is always up and running. Centralized Website Security by using a centralized SaaS solution and website platform. This means that all security updates are automatically applied to our site. It is compliant with the Payment Card Industry Data Security Standards (PCI DSS) and as a result, it creates a secured payment gateway. Additionally, our site is also TL certified which supports the fact that it helps in protecting online financial transaction information.

 

2. Copyright

  1. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such content, contained on the Site is owned, controlled or licensed by or to Lir Business Services & Training Centre Ltd.

  2. Except as expressly provided in these Terms of Use, no part of the Site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication, distribution or for any commercial enterprise, without Lir Business Services & Training Centre Ltd’s express prior written consent.

  3.  You may use information on Lir Business Services & Training Centre Ltd’s website (such as course information) purposely made available by Lir Business Services & Training Centre Ltd, provided that you (1) not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

  4. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Lir Business Services & Training Centre Ltd on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

  5. You may not use the Site or any content for any purpose that is unlawful or prohibited by these Terms of Use or to solicit the performance of any illegal activity or other activity, which infringes the rights of Lir Business Services & Training Centre Ltd or others.

3. Disclaimers

  1. Lir Business Services & Training Centre Ltd does not promise that the site or any content, service or feature of the site will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the site will provide specific results. The site and its content are delivered on an "as-is" and "as-available" basis.

  2. All information provided on the site is subject to change without notice. Lir Business Services & Training Centre Ltd cannot ensure that any files or other data you download from the site will be free of viruses or contamination or destructive features. Lir Business Services & Training Centre Ltd disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose.

  3. Lir Business Services & Training Centre Ltd disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the site and/or any Lir Business Services & Training Centre Ltd services. You assume total responsibility for your use of the site and any linked sites. Your sole remedy against Lir Business Services & Training Centre Ltd for dissatisfaction with the site or any content is to stop using the site or any such content. This limitation of relief is a part of the bargain between the parties.

  4. The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorised access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.

  5. Lir Business Services & Training Centre reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

 

4. Limitation of Liability

  1. Except where prohibited by law, in no event will Lir Business Services & Training Centre Ltd be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Lir Business Services & Training Centre Ltd has been advised of the possibility of such damages.

  2. If, notwithstanding the other provisions of these Terms of Use, Lir Business Services & Training Centre Ltd is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, Lir Business Services & Training Centre Ltd.’s liability shall in no event exceed the greater of (1) the total of any fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against Lir Business Services & Training Centre Ltd, or (2) EUR100.00.

 

5. Indemnity

  1. You agree to indemnify and hold Lir Business Services & Training Centre Ltd, its directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including legal fees), made Lir Business Services & Training Centre Ltd by any third party due to or arising out of or in connection with your use of the Site.

6. Purchasing Courses Online or on the Phone

  • Being ‘enrolled’ confirms that you have:

  • spoken to a Lir Training Professional to discuss suitability of the course to your requirements.

  • discussed the course entry pre-requisites (details on Course page)   - proof of same to be submitted to Lir within 1 week.

  • discussed the availability of the IT equipment required to complete your course online (see Course information page for details)

  • filled out a Lir Learner Registration Form online and paid the course fee.

  1. The Learner ensures that they have use of the IT equipment required to complete their course online.  See Course information page for details.

  2. If you decide to cancel your course within 14 days before the start date, Lir will refund your course fees within 28 days of receiving your notification of cancellation.

  3. Course fees are non-refundable once you commence a course.  For a definition of ‘commencing a course’, this means you have logged into the course page in Lir Learning Management System.

  4. Once you have enrolled as a Learner, if you decide to cancel your enrolment, this has to be done within 14 days of purchase. If you access more than 1 Unit on your course, you will not be entitled to a refund.

  5.  There is an administration fee of €60 which is non-refundable in the event of a cancellation.

  6. If you are on Flexi-payment Plan with Lir for payment of your course fees, you are required to give 60 days notice in writing, stating that you wish to cancel, however, the instalment payments will be payable during the period of this notice.

  7. Learners who have failed to log onto their course for 90 days or more, will be removed from their course.

  8. International Learners:[1] all QQI awards require Learners to hold an Irish or UK PPS No.  If Learners do not have a PPS No. they will not be eligible to receive an award.  In this regard, Learners will only receive a Certificate of Completion from Lir Business Services & Training Centre Ltd

 

7. Learners Transferring to another Course

  1. As an enrolled Learner, you are allowed to transfer to another course.  This process must be done within 30 days of enrolment.  This may incur additional course fees.  Learner must not have gone beyond Unit 1 in the Lir eLearning Hub on their first-choice course.

  2. There is an additional €60 fee for transferring from one course to another to be paid in full.

  3. Lir Business Services & Training Centre Ltd will not allow Learners to transfer a purchased course to another person.

8  Payment of Course fees

  1. The current course fee will be displayed on the website.  In the unlikely situation where an error on the course fee stated has been made by Lir, we will give you the choice to pay the difference or receive a refund.  If you receive a refund, you are not enrolled onto the course.  There are no administration fees applicable here. 

  2. Course fees are paid by Debit card, Credit Card, or EFT (Electronic Fund Transfer).

  3. Learners who withdraw from their course and have not fully paid for their course, are still liable for the course fee in full.

  4. Lir Business Services & Training Centre Ltd reserves the right to withhold certification for Learners with an outstanding balance still due on their account.

 

9  Learner wants to Defer their Course.

  1. You may make a request by filling out the Lir Learner Deferral Request form and it is at the discretion of Lir Management whether or not to approve this request.  An additional fee may be required.

 

10 Learner Responsibilities

  1.  Assessments for certification must be completed by the Learner to a satisfactory standard.  Learners may be requested to re-submit their assessment but this may impact the Learner’s ability to submit on time. A ‘Fail’ grade follows two submissions where a Learner does not meet the assessment criteria.

  2. Lir Business Services & Training Centre Ltd is not responsible for holding onto parts of assessment that have been uploaded to Assignments where the assessment submission date has expired.

  3. Regarding a Work Experience module, you must ensure that the placement setting you have/will secure is a suitable setting in line with your line of study.  It can be current relevant work, paid or unpaid.

  4. Regarding QQI Skills Demonstrations.  Learners need to ensure that if they are completing a course with skills demonstrations as part of their assessment, that they have access to a professional workspace to fulfil the assessment requirements.

 

11 Our Liability to you

  1. If you are not satisfied with our services and training provision, you can fill out the Lir Learner Complaints Form and/or write to The Director of Training, Lir Business Services & Training Centre Ltd email frances@lirbusinesscentre.com

  2. If, due to an event beyond our control, which includes, but not limited to, fire, flood, storm, strikes or other industrial action, failure of telecommunication services, riots, war, or the actions of any government or public body, we shall not be responsible to you. If we are prevented from providing the services to you we will do what we can to reinstate the provision of services as soon as is reasonably practicable.

  3. In no event do we accept responsibility to you for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer.  In no event shall we be liable to you for any indirect or consequential loss that you may suffer.

  4. We shall not be held responsible to you for any data that you lose through accessing the Lir e-Learning Hub course materials, Assessment Submissions or during the completion of your course.  It is your responsibility to ensure that you have backups of all your own data and all data that you produce when completing the course.

  5. Except where the above applies, our maximum aggregate liability to you for any claim that you may have against us under or in connection with the provision by us to you of the services which is not otherwise excluded in these Terms (including without limitation where such claim arises as a direct result of any negligent technical advice provided by us and/or by Lir Business Services & Training Centre Ltd) shall be limited to the amount of the course fee which has been paid or is payable by you or on your behalf.

  6. Each provision of this paragraph shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.

 

12 Your use of the Lir Course Materials and Resources

  1. Once we receive the course fee, we grant you a non-exclusive, non-transferable licence for you to use the Course Materials and resources for the sole purpose of non-commercial home or work use.

  2. Save as expressly set out in these Terms, you may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any of the Course Materials or resources. Any use of the Course Materials and resources not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of our copyright or our other intellectual property rights, and/or the copyright or other intellectual property rights of our licensors.

13 Learner Protection

  1. Lir Business Services & Training Centre Ltd has put in place appropriate arrangements for the protection of learners on QQI programmes which have a duration of three months or longer, should Lir Business Services & Training Centre unexpectedly cease to provide such a QQI programme. To comply with this, Lir Business Services & Training Centre Ltd has either: (1) arrangements in place with at least two other QQI registered organisations so that learners may transfer to complete their programme, or (2) an Insurance with Arachas/Insurance policy in place so that learners may be refunded. This applies to programmes that are 3 months or longer. Please note that the Insurance Policy will expire on the same date as the expiry date of your course.

  2. For programmes 3 months or longer: “Lir Business Services & Training Centre Ltd has the approval to offer students learner protection insurance.  Learner Protection Insurance is only in place when each student receives their Insurance Policy.  Each Learner should ensure that they receive a Learner Protection Insurance Policy in their name.  Learner Protection Insurance is provided by Arachas and underwritten by Aviva Insurance Ireland DAC.  Aviva Insurance Ireland DAC, trading as Aviva, is regulated by the Central Bank of Ireland.  The Learner Protection Policy provides for a refund of fees as specified in the 2012 Act.  In some circumstances, it may be possible for a learner to transfer to a similar programme with another provider.  In such circumstances, the learner may opt to receive the cost of an alternative similar academic programme.  The Learner Protection Insurance policy is governed by s. 65(4)(b) of the 2012 Act.” 

  3. Learners agree that in the event of Lir Business Services & Training Centre Ltd ceasing to provide a QQI programme which is 3 months or longer, that learner data (including registration data and assessments) may be transferred to QQI or QQI registered organisations to assist in the completion of the programmes.

 

14  General

  1. These Terms are governed by and shall be construed in accordance with EU and Irish law. Any dispute arising between us under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the Irish courts.

  2. These Terms constitute the entire agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services. You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms (which includes, for the avoidance of doubt, the description of the Services set out on the Website). Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation.

  3. The continued use of our services following any changes to the terms will mean that you accept such changes.
